Today the U.S. Court of International Trade released its opinion in the appeal of the 2021-2022 review of the antidumping duty order on shrimp from India. ASPA had joined in the appeal to challenge the Department of Commerce’s acceptance of certain sales reported by one Indian respondent during the review. ASPA also helped defend against the Indian producer’s own appeal challenging certain aspects of Commerce’s determination.
In the opinion released today, the Court agreed with ASPA’s challenge and has instructed Commerce to go back and reexamine the evidence on the sales at issue. The Court also rejected most of the Indian respondent’s claims. However, the Court has permitted Commerce to look again at the record on one issue raised by the Indian company.
ASPA will continue to participate in the proceeding while it is on remand at Commerce and when it comes back up to the Court for review. ASPA will advocate for the fullest amount of relief from unfair dumping that the domestic industry is entitled to under the law.
